The Registrar ordinarily serves a copy of the notice on the applicant within three months of receiving it.<\/p>\n\n\n\n<h3 id=\"h-simple-example\" class=\"wp-block-heading\"><strong>Simple example<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose <strong>ABC Foods Pvt. third party after the application has been advertised in the Journal.<\/p>\n\n\n\n<h3 id=\"h-why-does-this-distinction-matter\" class=\"wp-block-heading\"><strong>Why does this distinction matter?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Because the deadlines, documents and response process are different.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you receive an examination report, you are dealing with the Registry&#8217;s examination process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you receive a <strong>notice of opposition<\/strong>, you are dealing class=\"wp-block-paragraph\">The applicant should therefore read the <strong>actual notice of opposition<\/strong> instead of assuming that the dispute is simply about the name being similar.<\/p>\n\n\n\n<h1 id=\"h-what-information-does-a-trademark-opposition-notice-contain\" class=\"wp-block-heading\"><strong>What Information Does a Trademark Opposition Notice Contain?<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Rule 43 specifies information that must be included in a notice of opposition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This includes information relating to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The trademark application being opposed<\/li>\n\n\n\n<li>Application number<\/li>\n\n\n\n<li>Goods or services being opposed<\/li>\n\n\n\n<li>Name of the trademark applicant<\/li>\n\n\n\n<li>Earlier trademark or earlier right relied upon<\/li>\n\n\n\n<li>Opponent<\/li>\n\n\n\n<li>Grounds on which the opposition is based<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The notice must also be properly verified.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This information is important because it tells the applicant <strong>what exactly is being challenged<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, an opposition may not necessarily concern every class or every product covered by an application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If an application covers multiple classes, the opposition may relate only to particular classes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rule 42 also contains provisions concerning opposition against particular classes and division of applications in certain circumstances.<\/p>\n\n\n\n<figure Decision<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Registrar communicates the decision to the parties in writing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rules 42\u201350 of the Trade Marks Rules, 2017 provide the principal procedural framework for these stages.<\/p>\n\n\n\n<h1 id=\"h-how-long-do-you-have-to-respond-to-a-trademark-opposition\" class=\"wp-block-heading\"><strong>How Long Do You Have to Respond to a Trademark Opposition?<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">This is one of the most important questions for an applicant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under <strong>Rule 44<\/strong>, the applicant&#8217;s counterstatement must be filed in <strong>Form TM-O within two months from receipt of the copy of the notice of opposition from the Registrar<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This should not be confused with the four-month period available for filing the initial opposition.<\/p>\n\n\n\n<h3 id=\"h-the-two-deadlines-are-different\" class=\"wp-block-heading\"><strong>The two deadlines are different<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Opponent:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Four months from publication or republication of the trademark application in the Journal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Applicant:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Two months from receipt of the copy of the opposition notice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Keeping these dates separate is important.<\/p>\n\n\n\n<h3 id=\"h-what-should-you-do-after-receiving-the-notice\" class=\"wp-block-heading\"><strong>What should you do after receiving the notice?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Immediately:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Note the date of receipt.<\/li>\n\n\n\n<li>Check the trademark application number.<\/li>\n\n\n\n<li>Identify the opponent.<\/li>\n\n\n\n<li>Read all grounds raised.<\/li>\n\n\n\n<li>Check the goods or services involved.<\/li>\n\n\n\n<li>Record the counterstatement deadline.<\/li>\n\n\n\n<li>Gather relevant documents.<\/li>\n\n\n\n<li>Prepare the response.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Do not rely only on the date shown on the original trademark application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The counterstatement deadline under Rule 44 is linked to <strong>receipt of the opposition notice<\/strong>.<\/p>\n\n\n\n<h1 id=\"h-what-is-a-counterstatement-in-trademark-opposition\" class=\"wp-block-heading\"><strong>What Is a Counterstatement in Trademark Opposition?<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">A <strong>counterstatement<\/strong> is the applicant&#8217;s formal response to a trademark opposition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Rule 44, it is filed in <strong>Form TM-O<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The counterstatement sets out the applicant&#8217;s position regarding the facts alleged in the notice of opposition, including which facts, if any, are admitted. It must also be verified in the prescribed manner.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A counterstatement should therefore be more than a simple statement such as:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe want to register our trademark.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It needs to address the opposition raised against the application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The appropriate response depends on:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The opponent&#8217;s identity<\/li>\n\n\n\n<li>The grounds of opposition<\/li>\n\n\n\n<li>The trademark involved<\/li>\n\n\n\n<li>Goods and services<\/li>\n\n\n\n<li>Earlier marks or rights relied upon<\/li>\n\n\n\n<li>Applicant&#8217;s use of the mark<\/li>\n\n\n\n<li>Relevant supporting evidence<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Because every opposition can involve different facts, the contents of a counterstatement should be prepared based on the actual notice received.<\/p>\n\n\n\n<h1 id=\"h-what-happens-after-the-counterstatement\" class=\"wp-block-heading\"><strong>What Happens After the Counterstatement?<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">The trademark opposition does not end after the applicant files the counterstatement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The matter may move into the <strong>evidence stage<\/strong>.<\/p>\n\n\n\n<h3 id=\"h-evidence-by-the-opponent\" class=\"wp-block-heading\"><strong>Evidence by the opponent<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Under Rule 45, the opponent has two months from service of the counterstatement to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Submit evidence by affidavit, or<\/li>\n\n\n\n<li>Inform the Registrar and applicant that it does not wish to submit evidence and intends to rely on the facts stated in the notice of opposition.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If the opponent takes no action within the prescribed period, the Rules provide that the opposition is deemed abandoned.<\/p>\n\n\n\n<h3 id=\"h-evidence-by-the-applicant\" class=\"wp-block-heading\"><strong>Evidence by the applicant<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Under Rule 46, the applicant gets two months after receiving the opponent&#8217;s evidence or relevant intimation to submit evidence by affidavit or indicate that it does not wish to submit further evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the applicant takes no action within the prescribed period, the application is deemed abandoned under the Rule.<\/p>\n\n\n\n<h3 id=\"h-evidence-in-reply\" class=\"wp-block-heading\"><strong>Evidence in reply<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Rule 47 provides the opponent with one month from receiving the applicant&#8217;s affidavit copies to submit evidence by affidavit in reply.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Rules also contain provisions concerning further evidence in appropriate circumstances.<\/p>\n\n\n\n<h1 id=\"h-what-documents-can-be-used-as-evidence-in-a-trademark-opposition\" class=\"wp-block-heading\"><strong>What Documents Can Be Used as Evidence in a Trademark Opposition?<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">The evidence required depends on the facts and grounds of the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the circumstances, relevant records may include:<\/p>\n\n\n\n<h3 id=\"h-business-use-evidence\" class=\"wp-block-heading\"><strong>Business-use evidence<\/strong><\/h3>\n\n\n\n<ul
